Auto and trucking claims

Funding while your car accident claim runs its course

The car is totaled, the paychecks stopped, and the adjuster is in no hurry. Funding buys you the time to be patient.

Non-recourseIf you don't recover, you owe us nothing.
No monthly paymentsWe're repaid once, out of the settlement.
Case, not creditApproval turns on your claim, not your score.

Auto claims look like the simplest kind of personal injury case and often take the longest. Liability may be clear from the police report and the claim can still take a long time while treatment records are gathered, causation is questioned, and the parties work toward a number.

Meanwhile you may be without a vehicle, which in most of California means without a way to work.

Auto and trucking claims

What stretches an auto claim out

Several things can extend a car accident case well past what anyone predicted at the start.

Treatment that isn't finishedAttorneys generally wait until the medical picture is stable before valuing a claim. If you're still treating, the claim usually isn't ready.
Coverage that has to be foundWhen the at-fault driver carries little or no insurance, the case turns to your own underinsured coverage — a second claim, against your own carrier, on its own timeline.
Disputed causationCausation is commonly disputed — whether the impact caused the injuries, or whether a prior condition explains them. Answering that takes records and sometimes an expert.
Commercial defendantsWhen a truck or a company vehicle is involved, there's a corporate defendant with real counsel and a real incentive to fight.

Losing the car is the part nobody plans for

Property damage usually resolves faster than the injury claim, but not always fast enough, and not always for enough to replace what you were driving.

In most of this state, no vehicle means no commute, which can mean no income — on top of the income you already lost to the injury. That's the spiral funding is meant to interrupt.

There are no restrictions on what you do with an advance. If replacing the car is what gets you back to work, that's a good use of it.

Why this isn't a loan

A loan is money you have to pay back. This isn't that. We buy a portion of whatever your case eventually pays, and our right to be repaid exists only if there are proceeds.

That's what non-recourse means — we take on the risk that the case comes back with nothing.

It also means we can't touch your credit, your paycheck, your car or your home if the case doesn't go your way.

Questions

Common questions.

Can I get funding if I was partly at fault?

Possibly. California reduces recovery by your share of fault rather than barring it, so a case with shared fault can still have value. It affects the analysis, not necessarily the answer.

What if the other driver was uninsured?

It depends on what coverage is available, including your own. Tell us early — it changes the shape of the claim.

Does a police report guarantee approval?

No. A report that clearly assigns fault helps, but it's one piece. We also look at your injuries, your treatment and the coverage available.

My case is against a trucking company. Is that different?

Usually bigger and slower, with more insurance behind it. Those are often exactly the cases where waiting pays.
