Three things have to be true before we can consider a request: you have a pending legal claim, you are represented by an attorney handling it on contingency, and the claim is pending in California. Beyond that, we review the individual claim. Approval is never guaranteed.
The three requirements
You have a pending claim
Funding is an advance against a claim's potential proceeds. If there is no claim, there is nothing to advance against. A claim that has already settled is a different product and not what this page describes.
You are represented
You need an attorney handling your claim, typically on a contingency fee. California requires a written attorney acknowledgment in a consumer legal funding contract under Business and Professions Code sections 6250–6256, so counsel is built into the transaction. We do not refer consumers to attorneys and do not accept referral payments.
The claim is pending in California
California is where we fund. If your case is filed elsewhere, call and ask anyway — we will tell you plainly whether we can help.
What we review
We underwrite the claim, not the applicant. There is no credit check and your employment status is not part of the decision. What we look at:
- Liability. How clear is it that someone else is responsible?
- Injuries and treatment. Is there a medical record documenting what happened to you?
- Available coverage. Is there insurance or another source able to pay a recovery?
- What is already claimed against the recovery. Medical liens, prior advances from other funders, and your attorney's fee all come out of the same proceeds.
That last item is the one people most often leave out, and it is the one most likely to stop a request late. Disclose prior advances at the start.
What generally does not disqualify you
- Bad credit, no credit, or a past bankruptcy — see funding with bad credit
- Being out of work, which is often the reason people need funding
- Being partly at fault. California reduces recovery by your share rather than barring it
- Still being in treatment. Most people we fund are mid-treatment
- Having already taken an advance, as long as you tell us
What we cannot fund
- A claim with no attorney on it
- A claim where no recovery source can be identified
- A claim where so much is already committed that little would be left for you
- Anything outside the types of claims we work with — see cases we consider
Approval is not guaranteed
Nothing on this page is an offer of funding or a promise that any request will be approved. Every request is reviewed individually and may be declined for any lawful reason. If we decline, we will tell you rather than leaving you waiting.
