Pedestrian and cyclist claims

Funding after a pedestrian accident

These are the injuries that keep people out of work the longest — and the claims that take longest to resolve.

Non-recourseIf you don't recover, you owe us nothing.
No monthly paymentsWe're repaid once, out of the settlement.
Case, not creditApproval turns on your claim, not your score.

There is nothing between a person and a vehicle. Injuries in pedestrian collisions can be severe, and serious injuries generally mean longer treatment and longer time away from work.

Claims involving serious injuries also tend to take longer to resolve, because the full extent of the harm has to be established before the claim can be valued.

Pedestrian and cyclist claims

Why these cases sit

The very things that make a pedestrian claim valuable are the things that slow it down.

Long treatment horizonsOrthopedic injuries, surgeries and rehabilitation take time, and the claim can't be valued properly until the medical picture is clear.
Bigger numbers, harder fightsHigher-value claims tend to attract more scrutiny, more defense resources and more expert involvement than minor collisions do.
Contested circumstancesWhere you were crossing, what the light showed, what the driver could see — these get litigated, sometimes with accident reconstruction on both sides.
Multiple potential defendantsBeyond the driver there may be questions about the roadway, the lighting or the signal timing, each adding parties and delay.

The cost of waiting is higher here

Someone who can't walk without assistance usually can't work, can't drive, and may need help at home. The expenses go up at exactly the moment the income goes to zero.

That combination is what puts pressure on a plaintiff to accept an early offer, because it can arrive at the moment the money is needed most.

Funding exists to make that a choice rather than a necessity. It does not make your case worth more — it makes it possible for you to wait for what it's already worth.

Why this isn't a loan

A loan is money you have to pay back. This isn't that. We buy a portion of whatever your case eventually pays, and our right to be repaid exists only if there are proceeds.

That's what non-recourse means — we take on the risk that the case comes back with nothing.

It also means we can't touch your credit, your paycheck, your car or your home if the case doesn't go your way.

Questions

Common questions.

I wasn't in a crosswalk. Does that end it?

Not necessarily. Where you crossed is one factor among many, and California apportions fault rather than barring recovery outright. Drivers still owe a duty of care.

I'm still in treatment. Is it too early?

No. Most of the people we fund are mid-treatment — that's when the money is needed and when the case is furthest from resolving.

Can my family apply on my behalf?

The funding agreement has to be with the person whose claim it is, though family often help with the paperwork. If there's a conservatorship or the claim is on behalf of someone who died, tell us and we'll explain how it works.

Does this cover bicycle accidents?

Yes. Cyclists struck by vehicles face the same pattern of severe injury and slow resolution.
