A collision with a commercial truck is legally a different animal from a collision with a car. There is usually a company behind the driver, a federal regulatory layer governing how that company operates, and defense counsel involved within days rather than months.

All of that generally means a larger claim and a longer road to resolving it.

Commercial trucking claims

Why trucking cases take so long

The features that make these claims valuable are the same ones that slow them down.

More than one defendantThe driver, the motor carrier, the trailer owner, a maintenance contractor, a broker or a shipper may all be in the case. Each new party adds counsel, discovery and delay.
A federal regulatory layerInterstate carriers operate under federal rules covering driver hours, qualification, inspection and maintenance. Establishing a violation takes records that come from the carrier, usually through discovery.
Evidence that has to be preservedElectronic logging data, telematics, dashcam footage and maintenance records can be overwritten or discarded on routine schedules. Early preservation letters matter, and fights over what was retained are common.
Defense resources from day oneCarriers and their insurers often have investigators at the scene quickly. You are not negotiating with a claims adjuster working alone.

A larger claim doesn't help you pay rent

Commercial policies are generally far larger than the minimums carried on passenger vehicles, which is part of why these claims are worth pursuing properly.

But a claim being worth more does nothing for you in month four. If anything it extends the wait, because larger exposure invites a harder defense.

Funding exists to make the longer road survivable, so the size of the eventual recovery isn't decided by how long you could hold out.

Why this isn't a loan

A loan is money you have to pay back. This isn't that. We buy a portion of whatever your case eventually pays, and our right to be repaid exists only if there are proceeds.

It also means we can't touch your credit, your paycheck, your car or your home if the case doesn't go your way.

Questions

Common questions.

My case is against a trucking company. Does that change anything?

It usually means a larger claim and a longer timeline. Both are factored into the review.

The driver was an independent contractor. Does that matter?

It can affect which parties are responsible, which is one of the questions your attorney works through. It doesn't prevent you from applying.

How long do these take?

Longer than a typical auto claim, but it varies considerably. No one can tell you a reliable number at the outset.

Is approval guaranteed?

No. Every request is reviewed individually and may be declined.
